The Service Members Civil Relief Act

Under this law, lawsuits against active duty military personnel can be postponed during the active duty period and for up to 60 days after the end of the active duty period. This includes divorce cases. If the service member wishes the divorce to proceed however, the service member can petition the court to go ahead with the divorce.

Property Division and Military Divorce

In a military divorce in Pennsylvania, division of property is subject to the laws of the state, with one notable exception. Division of military pensions is subject to the federal Uniformed Services Former Spouses Protection Act (USFSPA) which in fact allows the court to apply Pennsylvania law in the division of a divorcing service member's disposable pension pay, subject to some restrictions. The spouse of the service member may be entitled to health care benefits as well.
